JESS Holdings, Inc. d/b/a The Goddard School located in Avon, Ohio (“the School”, “our” or “we”) is committed to protecting yours and your child’s privacy, which is why we have adopted this Privacy Policy.  This Privacy Policy lets you know how and for what purposes your and your child’s personal information is being collected, processed and used.  We pledge that we will take reasonable steps to ensure that you and your child’s personal information will only be used in ways that comply with this Privacy Policy.  As used in this Privacy Policy, “child” shall mean child or children, as applicable, and shall refer to each of your children and/or any of your children, as applicable. 

 

The School is an independently owned and operated franchise of Goddard Systems, Inc. (“GSI”). Information that we collect from you or your child may be stored on GSI’s secured computer servers on our behalf.  While we are responsible for the collection, storage and treatment of all information that we collect, we want you to be aware that GSI has access to some or all of that information. When you submit information to us, you accept that this information will be shared with GSI.  GSI will treat information about you and your child in accordance with its Privacy Policy http://www.goddardschool.com/privacy-policy.  GSI is not responsible for the operation of any School or for the conduct of its franchisees, and their collection and use of personal information. 

This Privacy Policy is in effect for the collective non-user-specific information and personal information received and/or collected by the School from you and your child from any source, including but not limited to, your application, your enrollment agreement, your communications with the School, your use of the Website, etc.  Your use of any web pages, mobile applications, third party social media sites, email lists, online features, services and/or programs offered by the School (collectively, the “Website”) is governed by this Privacy Policy.  Your use of the Website is also governed by its Terms and Conditions http://www.goddardschool.com/terms-and-conditions and by GSI’s Privacy Policy.  For the sake of clarity, this Privacy Policy only applies to information the School receives and/or collects from you and/or your child.  This Privacy Policy is not applicable to any information collected and/or received from you and/or your child by any entity other than the School, including GSI. 

 

Types of Information the School Collects or Receives

 

In providing you with services, we collect and receive, and are continually collecting and receiving, personal information about you and your child.  The School stores and uses the information that we collect or receive in strict compliance with applicable state and federal law.  The types of personal information the School collects or receives may include: (1) names; (2) home or mailing addresses; (3) email addresses; (4) biographical information (such as household data and demographic information); (5) home, businesss and/or mobile telephone numbers; (6) bank, credit card and/or other financial information; (7) date of birth; (8) health assessments, medical condition information, allergy information, medication information and immunization status; (9) injury, behavioral, accident, incident and illness reports, including, but not limited to, crime and police report information; (10) scholastic performance data; and (11) other personal information that is not generally available to the public. 

 

The means by which the School collects or receives such personal information includes when you: (1) apply for and/or enroll in the School; (2) request information through the Website or otherwise; (2) access a School social media platform; (3) sign up for email notifications, electronic newsletters, mobile messages (including SMS), or social media notifications from the School or; (4) provide the School with comments, suggestions or other input through the Website, surveys or otherwise; and (5) otherwise provide information to the School or to GSI.  We may also receive information from third parties, including as part of any investigation or inquiry that we or others may undertake.

 

Website Information Collected

 

The School may collect two types of information when you visit or use the Website: contact information and usage information.

 

Contact Information

 

Contact information refers to the information that you intentionally provide to us when you submit a request to be contacted.  This information may include your name, address, phone number(s), email address, child’s name and child’s date of birth, as well as any other information that you may voluntarily provide through the Website.  We collect this information for purposes of responding to requests for more information about the School and, if you enroll, for the other purposes described herein.

 

 Usage Information

 

The School may obtain non-individualized, generic information about you when you visit the Website.

 

Browser Log Files

 

The computer servers automatically log each visitor to the Website and collects and records certain information about each visitor.  This information includes or may include your Internet Protocol (“IP”) address, browser language, browser type, operating system, domain names, browsing history (including time spent at a domain, time and date of your visit), referring/exit web pages and URLs, and number of clicks.  The domain name and IP address reveal nothing personal about the user other than the IP address from which the user has accessed the Website.  We may use this information to examine our traffic in the aggregate, but do not collect and evaluate this information for individuals.

 

Cookies

 

From time to time, the School, GSI or other third parties may send a “cookie” to your computer.  A cookie is a small piece of data that is sent to your Internet browser from a web server and stored on your computer’s hard drive.  A cookie, by itself, cannot read data from your hard disk or read cookie files already on your computer.  A cookie, by itself, does not damage your system.  The School may use cookies to identify and keep track of, among other things, those areas of the Website and third party websites that you have visited in the past in order to enhance your next visit to the Website.  The School may also use cookies to ascertain how many times that you have seen an advertisement and obtain similar analytical information.  You can choose whether or not to accept cookies by changing the settings of your Internet browser, but your ability to use the Website may be impaired or prohibited.

 

Web Beacons

 

Parts of the Website and electronic communications may contain electronic images known as Web Beacons (sometimes referred to as “clear gifs”).  Web Beacons collect only limited information that includes a cookie number; time and date of a page view; and a description of the page on which the Web Beacon resides.  The Website may also carry Web Beacons placed by third party advertisers.  These Web Beacons do not carry any personally identifiable information and are only used to track usage of the Website and activities associated with the Website.

 

Unique Identifier

 

We assign you a unique internal identifier to help keep track of your future visits to the Website.  We use this information to gather aggregate demographic information about our visitors, and we use it to personalize the information you see on the Website and some of the electronic communications you receive from us.  We keep this information for our internal use, and this information is not shared with others.  This information is in no way tied to your personal information, including your email address.

 

Third Party Opt Out

 

Although we do not at the time this Privacy Policy was last updated (see end of Privacy Policy for last date of update), we may allow third-party companies to serve advertisements and/or collect certain anonymous information when you visit the Website. These companies may use non-personally identifiable information (including, but not limited to, click stream information, browser type, time and date, subject of advertisements clicked or scrolled over) during your visits to the Website in order to provide advertisements about goods and services likely to be of greater interest to you. These companies typically use a cookie or third party Web Beacon to collect this information, as further described above. Through these technologies, the third party may have access to and use non-personalized information about your online usage activity.

 

You can opt out of the collection of certain information about your online usage through any one of the ways described below (you do not need to go to each opt-out site, one is sufficient). After you opt-out, you will continue to receive advertisements, but those advertisements will no longer be as relevant to you.

 

·         You can opt-out via the Network Advertising Initiative industry opt-out at www.networkadvertising.org.

·         You can opt-out via the Consumer Choice Page at www.aboutads.info.

·         You can configure your web browser (Chrome, Firefox, Internet Explorer, Safari, etc.) to delete and/or control the use of cookies.  More information can be found in the Help system of your browser.  It is at your discretion whether you use the opt-out described above or manage cookies via the browser.

 

Note: If you opt out as described above, you should not delete your cookies.  If you delete your cookies, you will need to opt out again.

 

Use of Information

 

Information collected or received by the School is used for five main purposes.  First, we collect information to provide you with services and improve your and your child’s experience with the School.  Second, we may now or in the future collect information to personalize the experience of the users of the Website.  Third, we collect information to communicate with you and to inform you about your child, the School and our services.  Fourth, we use information collected for our internal business purposes (e.g., business planning, program development, etc.).  Finally, we may collect or otherwise receive information about you or your child for the purpose of giving you additional information about the School, our program, or other Goddard Schools.

 

When Information Is Disclosed By the School

 

In addition to the other times or occasions on which we might disclose information, we might also disclose information when required by law or in the good-faith belief that such disclosure is necessary to: (1) comply with a legal process and applicable laws; (2) enforce this Privacy Policy; and/or (3) investigate and/or protect the rights, property or personal safety of you, your child, the School, our employees, GSI or the public.

 

We use reasonable precautions to keep secure the information that is disclosed to us.  We may provide personally identifiable information and non-personally-identifiable information to other businesses or persons for the purposes of processing such information on our behalf.  We require that these parties agree to process such information in compliance with our Privacy Policy or in a similar, industry-standard manner, and we use reasonable efforts to limit their use of such information and to use other appropriate confidentiality and security measures.  The use of your information by one of our business partners may be subject to that party’s own Privacy Policy.

 

We may share non-personally identifiable information (such as anonymous usage data, referring/exit pages and URLs, platform types, number of clicks, etc.) with third parties to demonstrate the usage patterns for  the School’s advertisements, content, functionality, promotions and/or services on the Website.

 

We also reserve the right to disclose personally identifiable information and/or non-personally-identifiable information in connection with the enforcement of the Website’s Terms and Conditions, to take precautions against liability, to investigate and defend against any third-party claims or allegations, to assist government enforcement agencies, to protect the security or integrity of the Website and to protect the rights, property, or personal safety of the School, School employees, our students and their families or GSI.

 

We reserve the right to transfer your personally identifiable information, as well as any other information, in connection with the sale or other disposition of all or part of the School’s business and/or assets.  We cannot make any representations regarding the use or transfer of your personally identifiable information or other information that we may have in the event of our bankruptcy, reorganization, insolvency, receivership or an assignment for the benefit of creditors.  Furthermore, we cannot and will not be responsible for any breach of security by any third parties or for any actions of any third parties that receive any of the information that is disclosed by us.

 

Employment Application and Information Collection

 

The Privacy Policy also applies to job application inquiries that you may transmit to us on paper, through the Website or otherwise.  The Website currently allows job applicants to submit information for consideration.  By submitting any such information, you consent to its use by us in compliance with this Privacy Policy.

 

Privacy Outside the Website

 

The Website may contain various links to other websites, including links to one or more websites of GSI and various third parties.  The School is not and cannot be responsible for the privacy practices or the content of any of the linked websites.  Please check with the providers of those other websites in order to determine their privacy policies and your rights under them. 

 

Choices With Your Personal Information

 

Whether you submit personally identifiable information about you or your child to the School is entirely up to you.  You may decide not to submit personally identifiable information about you or your child to the School, in which case we may not be able to provide certain services to you, including enrollment.

 

You may choose to prevent the School from disclosing, storing or using your or your child’s personally identifiable information under certain circumstances (“opt out”).  You may opt out of certain disclosure, storage or use of your or your child’s personally identifiable information for purposes that are incompatible with the purpose(s) for which it was originally collected or for which you subsequently gave authorization by notifying us by one of the methods at the end of this Privacy Policy.  There are some uses from which you cannot opt out, such as our use, storage and/or disclosure of your or your child’s personally identifiable information in compliance with applicable laws, rules and regulations.  As long as one or more of your children are students at the School, you may not opt out of the School using your children’s personally identifiable information to the extent reasonably necessary (in our sole discretion) to provide services to you and your children.

 

You may opt out of online advertising based on your online usage patterns by following the instructions set forth above under the above section “Usage Information,” subsection “Third Party Opt Out.”

 

Access and Correction

 

To access your or your child’s personal information in the possession of the School and correct inaccuracies of that information in our records, please contact us in the manner specified at the end of this Privacy Policy.  We ask individuals to identify themselves and the information requested to be accessed and amended before processing such requests, and we may decline to process requests in limited circumstances as permitted by our then-current business practices and/or applicable laws, rules and regulations.

 

Information from Children

 

Through the Website

 

The Website is not intended or designed for use by children under the age of 13.  We do not use the Website to collect personally identifiable data from any person that we know to be under the age of 13, and we are in full compliance with the Child Online Privacy Protection Act (“COPPA”), as well as any and all other applicable privacy laws, rules and regulations.  If we discover that a child under the age of 13 has provided us with personal information, we will delete such information from our systems.

 

Notwithstanding anything in this Privacy Policy to the contrary, the sole circumstances under which we would knowingly receive personal information about a child through the Website are instances where the child’s parent(s)/guardian(s) provide that information. 

 

Outside of the Website

 

The School, GSI, and our and their respective service providers, do receive personal information about your children as a part of offering and providing you and your children with our services.  By applying for enrollment or enrolling your child at the School, you expressly agree that we, GSI and our and their respective service providers, will necessarily receive certain personal information about and potentially from your child.  As a result of this, you agree:

 

(1)   This Privacy Policy shall serve as notice to you regarding the School’s information practices with regard to children, including the types of personal information we may collect or receive from your child (through whatever source), the uses to which we may put that information, and whether and with whom we may share that information.

 

(2)   You have and hereby consent to the collection of personal information from your child (in any manner, including, but not limited to, inadvertent or unauthorized disclosure through the Website).

 

(3)   We have notified you that you have the right to request access to the personal information we at such time have collected from your child and the ability to request that such personal information be corrected or deleted.

 

We do not currently engage in any marketing activities to your child through the Website.  To the extent there is any change in this practice, such change will be posted to this Privacy Policy.  To be clear, the School treats privacy as a top priority, especially the privacy of any information about your child.

 

You affirm that you are either more than eighteen (18) years of age, or an emancipated minor, or possess legal parental or guardian consent, and are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations, and warranties set forth in this Privacy Policy, and to abide by and comply with this Privacy Policy.  In any case, you affirm that you are over the age of thirteen (13), as THE WEBSITE IS NOT INTENDED FOR CHILDREN UNDER 13 THAT ARE UNACCOMPANIED BY HIS OR HER PARENT OR LEGAL GUARDIAN.

 

Parents and legal guardians should be aware that the Privacy Policy will govern our use of personal data, but that information that is voluntarily given by children or others in email exchanges, bulletin boards or the like may be used by other parties to generate unsolicited communications.  The School encourages all parents and legal guardians to instruct their children in the safe and responsible use of their personal data while using the Internet.

 

California Privacy Rights

 

Under California’s “Shine the Light” law, California residents who provide personal information in connection with obtaining products or services for personal, family or household use are entitled to request and obtain from us once a calendar year information about the customer information we shared, if any, with other businesses for their own direct marketing uses.  If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared customer information for the immediately prior calendar year (e.g., requests made in 2013 will receive information regarding 2012 sharing activities).  

 

To obtain this information from the School, please send an email message to the email address provided at the end of this Privacy Policy with “Request for California Privacy Information” in the subject line and in the body of your message.  We will provide the requested information to you at your email address in response.  Please be aware that not all information sharing is covered by the “Shine the Light” requirements and only information required to be shared will be included in our response.  Please be further aware that the School will report only its own information, not the information sharing undertaken by GSI, if any, and you should consider making a similar request to GSI for that information.

 

 

Additionally, because we may collect your personal information from time to time, California’s Online Privacy Protection Act of 2003 (CalOPPA) requires us to disclose how we respond to “do not track” requests, signals and other similar mechanisms. Currently, our policy is that we do not recognize “do not track” requests and signals from Internet browsers and similar devices. The School is not in the business of tracking users for the purpose of building online usage profiles of visitors to the Website, and our use of your personal information is strictly limited to the uses described herein. A visitor to the Website delivering a “do not track” request or signal will be treated no differently than a visitor to the Website not delivering a “do not track” request or signal. Please see the “User Information” section herein to understand how this policy may affect you.

 

Changes to this Policy

 

This Privacy Policy is current as of the Effective Date set forth below.  We may change this Policy from time to time, so please be sure to check back periodically.  We will post any changes on our website.  If we make changes to this Privacy Policy that materially affect our practices with regard to personal information we have previously collected from you, we will make our best effort to provide you with notice in advance of such change by highlighting the change on our website.

 

Your Consent To This Privacy Policy

 

 

By visiting our websites or using any of our services, you consent to the collection and use of information by us, GSI and our respective agents as specified above or as we or they otherwise see fit, in compliance with this Privacy Policy (or their respective Privacy Policies), unless you inform us otherwise by means of the procedure identified below.  We may use comments, ideas, information, feedback or suggestions that you may submit in any manner that we may choose without notice or compensation to you.  You further agree that your personal information will be handled as described in this Privacy Policy.  Your use of our sites and services, and any disputes over privacy, is subject to this Privacy Policy, our Terms and Conditions of use, including any applicable limitiations on damages and the resolution of disputes, and GSI’s Privacy Policy.  Our Terms and Conditions and GSI’s Privacy Policy are incoproated by reference into this Privacy Policy.
